The CNPD concludes its review concerning potentioal fundamental rights violations of European citizens

No data protection violation found at Skype and Microsoft in Luxembourg


As of November 15th 2013, the National Commission for Data Protection (CNPD) has informed the applicants about the outcome of its review of their requests relating to the respect of their fundamental rights and freedoms regarding the processing of their personal data by Skype Communications S.A.R.L. and Microsoft Luxembourg S.A.R.L.


The fact finding operations conducted since July 2013 and the subsequent detailed analysis did not bringt to light any element that the two Luxembourg-based companies have granted the U.S. National Security Agency mass access to customer data. Furthermore, the transfer of certain personal data to affiliate companies in the US, as laid down in the privacy statements of both companies, appear to take place lawfully under the rules of the adequacy decision 2000/520/CE by the European Commission implementing the so called "Safe Harbor" agreement.


Therefore, the CNPD did not find any violations of the provisions of the Luxembourgish data protection legislation by Skype Communications S.A.R.L. or by Microsoft Luxembourg S.A.R.L.
